MEMBERS OF SMART TRANSPORTATION DIVISION LOCAL 662
NOTICE OF 2014 OFFICER/COMMITTEE ELECTIONS AND NOMINATIONS
On behalf of your duly elected Officers and membership and in accordance with Title IV of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA), Article 21B, Sections 56 & 57 of the SMART Constitution and Section XII of the SMART TD Local 662 By-Laws, you are hereby notified of the upcoming SMART TD Local 662 2014 Officer and Local Committee Elections.
Under the provisions listed above, an election shall be held for the following Local 662 office position(s):
- LOCAL PRESIDENT
- LOCAL VICE PRESIDENT
- LOCAL SECRETARY
- LOCAL TREASURER
- LOCAL TRUSTEE (3 positions)
- LOCAL DELEGATE
- ALTERNATE LOCAL DELEGATE
- LOCAL CHAIRMAN (4 positions)
- VICE LOCAL CHAIRMAN (4 positions)
- LOCAL COMMITTEE SECRETARY (4-a separate position from Local Secretary)
Nominations to fill the above office position(s) shall be accepted at the next Local 662 regular meeting in Richmond, VA to be held at the following location and time:
Please note that elected Officer positions will have terms that expire on December 31, 2017 with the exception of Local Delegate(s) & all Local Committee positions will expire in December 2018.
Nominations for all the above Local Officer and Local Committee positions shall be accepted at the next SMART Local 662 regular meetings in Richmond, VA to be held at the following location and time:

Nominations may be made from the floor at the nomination meetings. Nominations do not require a second motion. You may nominate yourself for any position. Where nominations are made by nominating petitions, at least five (5) members eligible to vote in this upcoming election shall sign that petition. For nominations of Local Committee positions, the nominating petition shall be signed by at least 5 members of that particular Committee. Petitions must be delivered to the Local Secretary prior to the close of the October 1, 2014 Richmond meeting. Nominations shall not be accepted after the close of the October 1, 2014 meeting in Richmond. Prospective candidates will be allowed, once, prior to the election to inspect a list of names and addresses of the membership eligible to vote. All nominated members must be in good standing and have paid dues during the month of October 2014. This election and certification shall be held by secret mail referendum commencing at the November 5, 2014 regular meeting in Newport News, VA to be held at the following location and time:

SMART Transportation Division Election Eligibility Requirements and General Information
as prescribed by the SMART Constitution, Local 662 By-Laws and Federal Law
Members Eligible to Vote
Except as otherwise provided in the SMART Constitution, no member shall be entitled to any of the rights or benefits of the SMART Transportation Division, unless dues and assessments are paid within the time specified herein. (Article 21B, Section 53, lines 1-2) Retired Members are among those not eligible to vote.
The dues and assessments of members shall be paid in advance, before the first day of the month in which they are due. (Article 21B, Section 49, lines 1-2)
During the period in which members request relief (E49) and are relieved from the payment of dues and assessments in accordance with this Article, they shall continue to enjoy all privileges of membership, except they shall not be permitted to vote in elections....( Article 21B, Section 49, lines 18-21)
Eligibility for Office (Article 21B, Section 7, lines 1-25)
Unless otherwise provided, any member paying full dues shall be eligible for election to any office in the SMART Transportation Division except a member who:
(a) Has attained age 65 or attains age 65 during year of election;
- The US Age Discrimination in Employment Act eliminates age an exception for eligibility for office the United States and cannot be applied to Union elections as written per paragraph (a).
(b) Holds membership in any other union representing transportation employees, other fields of employment, trades and industries, whether in public or private employment except when a member is forced by agreement to belong to another union;
(c) Is serving in an official capacity with a transportation company, other fields of employment, trades and industries, whether in public or private employment, except as yardmaster where the SMART Transportation Division holds the contract for yardmaster;
(d) Does not hold seniority rights in transportation service, other fields of employment, trades and industries, whether in public or private employment, except this does not apply when a member is dismissed from service and his/her case is being appealed;
(e) Voluntarily elects to receive a rebate of dues from any department will not be eligible to hold office in that department and will not be eligible for the offices of Delegate or Alternate Delegate, Legislative Representative or Alternate Legislative Representative;
(f) Is restricted from holding office by the Labor-Management Reporting Disclosure Act (LMRDA);
(g) Is an elected officer of the International shall not be eligible to the office of Delegate.
A member may not seek office in any Local other than the Local in which membership is held and that member may not serve on more than one Local Committee of Adjustment (LCA) at the same time. In order to participate in elections, you must be a member and have paid dues. For example, a member who has not paid June dues prior to the first day of the month in which they are due, or is otherwise not a member, cannot nominate or be nominated in June. However, the same member may become an eligible voter if that member gains membership after October 1, 2014 provided the October 2014 dues are paid in a timely manner. A person cannot submit a membership application after September 30, 2014 and pay September 2014 dues after September 30, 2014 in order to become eligible to run, vote or nominate.
Filling more than one elective Office (Article 21B, Sections 56 & 57)
No member may fill more than one (1) of these elective Local Officer positions at the same time. This does not prohibit a member from holding one of the elective offices and at the same time serving on a Local Committee of Adjustment (LCA), as Legislative Representative or Alternate Legislative Representative and/or Delegate or Alternate Delegate.
Election by Mail Referendum (Article 21B, Section 57)
This election shall occur by a secret mail referendum ballot. Official Ballots shall be mailed to all eligible voting members with voting instructions and return envelopes. All ballots must be mailed to the designated Local 662 Post Office Box before the election date in order to be counted. Mailed Ballots "walked-in" by voting members during the election meeting will be accepted prior to the beginning of the vote tabulation and certification. However, if you choose this option, you must bring in the Official Ballot that was mailed to you. If your mailed ballot becomes lost or it was received in an unusable condition, please contact the Local Secretary immediately for a new ballot to be mailed to you. Duplicate Ballots will not be made available at the election meeting. You must use the mailed ballot.
Distributing Campaign Literature (Labor-Management Reporting Disclosure Act-LMRDA)
Candidates for elective office may send materials to members regarding their qualifications, but letterheads of a candidate's Local or office must not be used for this purpose. Federal Law strictly prohibits the use of union and employer funds to promote the candidacy of any person in a union officer election. Secretary-Treasurers must address and mail out campaign materials for a candidate who requests such action. The candidate will be responsible for all expenses connected with such a request.
Inspecting Membership Voting Lists (Labor-Management Reporting Disclosure Act-LMRDA)
US Department of Labor regulations provide that each bona fide candidate and/or member seeking nomination for office has a right, once, to inspect within 30 days prior to any election a list containing the names and last known addresses of all members eligible to vote in that election. Candidates do not have the right to copy or obtain the membership list, nor can the Local Secretary supply copies of the list to the candidates or their representatives. Candidates only have the right to inspect and/or compare the list with a personal list of members.

Carini is located 1 mile west of Laburnum Avenue on Williamsburg Road (US Route 60) between the Richmond International Airport and Fulton Yard. This is off Interstate 64 at exit 195. Take exit 195 from I-64 onto East Laburnum and go approximately 1 mile south past the new White Oak Village Shopping Center to Williamsburg Road. Turn right on Rt. 60 and go 1 mile and look for Carini on the right at the Williamsburg Center.

Sam & Steve's is located on VA Route 143/US Route 17 (Jefferson Avenue) approximately 5.2 miles north of the Newport News Yard Office. Sam & Steve's is about ½ mile south of Harpersville Road. If you are coming from Richmond, take exit 255A from I-64E and stay on Jefferson Avenue Eastbound, like you are going to the Newport News Yard. Sam & Steve's is approximately 5.6 miles south of exit 255 on the right.
(Meetings are held in the Banquet Rooms)

If you plan to attend any meetings, plan to arrive 30-45 minutes early to place your dinner order and join us for "Social Hour."
All SMART Local 662 Members are encouraged to attend our regular monthly meetings.
