Below is the UTU (SMART Transportation Division) Local 662 New Member Guide that may also assist our new members with questions.  Below the New Member Guide are the updated 2013 Local 662 By-Laws

UTU (SMART Transportation Division) Local 662 represents CSX Conductors and Engineers holding seniority on the old C&O Proper Railroad from Clifton Forge to Richmond and Newport News.  UTU represents you and your profession in the Collective Bargaining Process. UTU also provides many benefits to its members thru insurance protection of its UTUIA subsidiary and being your leading voice in promoting railroad safety.

 

By now, you should have received various packets of information in the mail or when you began your training and railroad career at the CSX REDI Center from the UTU.  Take a few minutes to review this important information.  This includes the UTU Constitution, the 2010 CSX/UTU Consolidated Southern Region Agreement (CSRA Blue Book), US Railroad Retirement Board, National Health Plan (including National Dental, Vision and C&O Employee Hospital Association which will be your primary Health and Prescription provider).  If you did not receive any of these materials during your training, please contact your Local Chairman or Local Treasurer (see below).

 

The following Guide will help you become acquainted with what the UTU does on a local level here in Richmond and Newport News as well as answer any questions and concerns about your UTU (SMART Transportation Division) membership.

 

REPRESENTATION

 

On a Local level, you are represented by elected Local Officers and Local Chairmen.  From time to time, you will have many questions and concerns with respect to your working conditions, contract, safety and possible disciplinary actions by CSX.  Your Local Chairman is your first point of contact in dealing with these matters. Our Local has 4 Local Chairmen.  The Local Chairman that represents you is dependent upon where and what you are working.  This breaks down as follows:

DUES

 

Your UTU Local 662 Treasurer has the primary responsibility to ensure that all member monthly dues are collected and paid in full in a timely manner in accordance to Federal Law, the UTU Constitution and Local 662 By-Laws.


Soon, you will see payroll deductions for UTU 662 dues in your CSX paychecks. Your monthly dues are $145.56.  UTU Dues are deducted from your first CSX paycheck each month.  Your monthly dues are collected (deducted) one month in advance.  UTU dues are allocated as follows:


• $27.50 International

• $12.50 Legislative Affairs

• $49.06 General Committee of Adjustment (C&O Proper)

  $8.25 Local Committee of Adjustment

• $13.75 Local 662 dues

• $34.50 for participants of the (GDR) Anthem/UTUIA National Short-Term Automatic Disability Insurance Program.  The GDR plan is automatic and you will receive this insurance benefit immediately.  If you wish to not participate in the GDR disability program, please contact your Local Treasurer.


Your dues process works over a 3 month cycle as follows as this example explains:

• Let's say you work during the month of January, your dues are earned in this month (January).

• The January dues earned are now deducted from your first CSX check at the beginning of the next month (February).

• Those deducted dues from your first February CSX paycheck are now applied to the next month (March)


If you work 1 day during a calendar month, you are obligated to paying dues as per our working agreements with CSX.  Certain conditions exempt members from being obligated to pay dues when they are unable to work (medical, discipline, furloughs, etc.).


At the end of each year, Active Members receive an Annual Dues Receipt from the Local Treasurer that summarizes how much dues and insurance the member paid for that year.  Remember that Union Dues are tax deductible as a job related expense.  Consult the current IRS regulations or your accountant/tax preparer for more information.     

 

INSURANCE AND RETIREMENT

 

The Local Treasurer also serves as your local UTU Insurance Association Representative. UTU's largest benefit is the Discipline Income Protection Plan (Run-Off Insurance) which pays you benefits (money) when CSX holds you out of service for disciplinary actions.  In your railroad career, you will face some kind of disciplinary action by CSX for just doing your job and UTU is here to protect you and your family.  The UTU Insurance Association also offers to its members other insurance coverage such as Life, Disability Income Replacement Insurance (a separate coverage from the Automatic Group Disability Short Term Plan mentioned above), Accidental Death and Dismemberment, Cancer Hospital Indemnity, Annuities and Retirement Plans in addition to what is offered by CSX and the United States Railroad Retirement Board.

BY-LAWS OF THE

UNITED TRANSPORTATION UNION LOCAL 662

 

SECTION I

RECOGNITION OF NAME

This United Transportation Union (UTU) Local Organization shall be recognized, known and hereby called United Transportation Union (UTU) Local 662 until such time given a new number and/or name by United Transportation Union International also known as SMART Transportation Division.

 

SECTION II

REGULAR MONTHLY MEETINGS

Regular monthly meetings shall be held on the first Wednesdays of each month at the following alternating locations:

SECTION III

COMMENCEMENT AND ORDER OF MEETINGS

All regular monthly meetings shall commence and be called to order at 7:00 P.M. at the designated meeting locations as set forth in Section II and shall be subject to change as provided in Article 55 of the UTU Constitution.  The order of business shall be set forth as governed in Article 77 of the UTU Constitution.

 

SECTION IV

SPECIAL MEETINGS AND REGULAR MEETINGS IN OTHER LOCATIONS

Special meetings and regular monthly meetings held in locations other than the designated regular monthly meeting locations as prescribed in Section II may be held upon the written, petitioned and signed request from a quorum of five (5) members in good standing.  The request for such special meetings and/or regular monthly meetings in other locations shall be directed to the Local President.  The Local President shall attend these meetings, if available, or shall designate the Local Vice President to preside in his absence per Article 60 of the UTU Constitution.  The location, date and time of such meetings in this section shall be respected, wherever practicable, and determined per the request as specified from the quorum of five (5) members in good standing.  The minutes of these meetings shall be recorded and reported to the Local Secretary.   This section shall be governed by Article 55 of the UTU Constitution.

 

SECTION V

DESIGNATION OF LOCAL ELECTIVE OFFICERS

In accordance to and governed by Article 56 of the UTU Constitution, this United Transportation Union Local shall have elective officers consisting of the following positions:

  • Local President                                     Local Vice President
  • Local Secretary                                     Local Treasurer
  • Board of Trustees consisting of 3 members

SECTION VI

SALARIES OF LOCAL ELECTIVE OFFICERS

The Local President shall be compensated a monthly salary of $50.00 for the performance of duties as specified in Article 59 of the UTU Constitution.

 

The Local Vice-President shall be compensated the monthly Local President’s salary in lieu of the Local President for presiding over a regular monthly meeting or special meeting (as prescribed in Section IV) in the Local President’s absence for the performance of duties as specified in Articles 59 and 60 of the UTU Constitution.      

 

The Local Secretary shall be compensated a monthly salary of $150.00 for the performance of duties as specified in Article 63 of the UTU Constitution. 

 

The Local Treasurer shall be compensated a monthly salary of $150.00 for the performance of duties as specified in Article 64 of the UTU Constitution.  

 

Each member of the Board of Trustees shall be compensated annually one (1) basic day’s pay at the daily rate applicable to the craft and class of service in which regularly assigned for the performance of duties as specified in Article 67 of the UTU Constitution.

 

The provisions of Section VI are governed and subject to change as provided in Article 48 of the UTU Constitution.

 

SECTION VII

ADDITIONAL COMPENSATION AND EXPENDITURE REIMBURSEMENTS

All expenditure reimbursements pertaining to the performance of Officer Duties and/or official union business by other designated Local Representatives or members are to be reimbursed in full provided original receipts are remitted for those expenses.

 

All additional compensations and expenditure reimbursements are subject to approval by member ratification at regular monthly meetings as Bills of Allowance and are governed by and subject to change as provided in Article 48 of the UTU Constitution.   

 

SECTION VIII

DISBURSEMENTS OF LOCAL FUNDS

All disbursements from the Local fund shall be made by check from the designated local checking account.  All checks require the signature of both the Local President and Local Treasurer for disbursement.  Disbursements, except as provided in these By-Laws, shall be approved by the Local before disbursement is made as prescribed in Section VII.   No expenses shall be allowed for attending regional meetings, seminars, or other similar meetings unless prior approval is ratified by the Local at a regular monthly meeting.  The provisions of this section are governed by and subject to change as provided under Article 48 of the UTU Constitution.

 

SECTION IX

ALLOCATION OF DUES

UTU Dues shall be allocated for in-service active members as follows:

  • Local dues of in-service active members shall be $13.75 per month. 

 

  • The Local initiation fee for new members is currently waived ($25.00 maximum). 

 

All local dues are subject to change, approval and ratification as provided in Article 48 of the UTU Constitution.

 

SECTION X

REMEMBRANCE OF DECEASED MEMBERS AND THEIR FAMILIES

The Local President shall designate both the Local Secretary and Local Treasurer to arrange for appropriate floral presentations, religious articles or contributions to a designated charitable, research or fraternal organization in honor of any deceased current, retired or former local member on the behalf of the Local at a cost not to exceed $100.00.

 

SECTION XI

SAFETY COMMITTEE

Members of the Safety Committee shall be governed by the Safety Committee Guidelines and Collective Bargaining Agreements currently in effect as mutually agreed upon between the Carrier (CSX) and the United Transportation Union.   

 

SECTION XII

ELECTIONS

All elections for Local Officers and Local Committees of Adjustment representative positions shall be held by secret mail referendum ballot of eligible members in good standing, except the Legislative Representative, Alternate Legislative Representative, Delegate and Alternate Delegate shall be elected by secret ballot from the eligible members in good standing present at a regular or special meeting upon the completion of Officer and Committee elections.

 

Permanent vacancies, except as provided in Article 57 of the UTU Constitution, shall be filled by secret ballot of the eligible members in good standing present at a regular or special meeting.

 

The Local Secretary shall arrange to rent two (2) post offices boxes on a yearly basis, one at Richmond, Virginia and one at Newport News, Virginia for the purpose of complying with Article 57 of the UTU Constitution.

 

All elections shall be conducted in accordance with the provisions of Article 57 of the UTU Constitution and special instructions from the United Transportation Union International also known as SMART Transportation Division.   

 

SECTION XIII

BY-LAW AMENDMENTS AND REFERENDUMS

Amendments to the United Transportation Union Local 662 By-Laws shall be made in the following manner:

 

  • The Local President shall designate and establish a By-Laws Review Committee.   This committee shall consist of at least one (1) elected Officer and not less than two (2) other members in good standing.   This committee shall review and propose changes to the By-Laws given by any member in good standing.   

 

  • Any member in good standing desiring to make a proposal for changes or amendments of the UTU Local 662 by-laws shall submit these proposals in writing to the By-Laws Review Committee or Local Secretary.  

 

  • After committee review, all amendment proposals shall be submitted in writing to the Local Secretary.

 

  • The Local Secretary shall make available to all members the By-Laws amendment proposals for review.  A reasonable length of time will be given to all members to review amendment proposals before presentation at a regular meeting. 

 

  • All proposals shall be read, reviewed and debated at a minimum of least two (2) consecutive regular monthly meetings.  After review at such meetings, a vote shall take place with a majority required for amendment by eligible members in good standing present.  Upon approval, the new By-Laws shall be signed by five (5) members in good standing affirming adoption of the new By-Laws.  The amendments shall become effective and supersede any existing By-Laws on the first day of the month following the approval of the United Transportation Union International President also known as SMART Transportation Division President.

 

  • Such amendments and proposals shall not be voted upon prior to the first meeting following the initial presentation by the By-Laws Review Committee.
